Mersin Marina dev bir AVM&#8217;nin s\u00fcs havuzu olmu\u015ftur.&#8221; dedi.<\/p>\n<p>Temeli 1994 y\u0131l\u0131nda Tansu \u00c7iller taraf\u0131ndan at\u0131lan ve 2011\u2019de hizmete a\u00e7\u0131lan Mersin Marina&#8217;n\u0131n \u201cYap-\u0130\u015flet Devret\u2019 Modeli ile Do\u011fu Akdeniz\u2019de yat turizminin canlanmas\u0131 i\u00e7in yap\u0131ld\u0131\u011f\u0131 fakat, \u2018Amac\u0131 d\u0131\u015f\u0131na \u00e7\u0131kart\u0131l\u0131p, AVM\u2019ye d\u00f6n\u00fc\u015ft\u00fcr\u00fcld\u00fc\u2019 su\u00e7lamas\u0131yla kar\u015f\u0131ya kalan marinaya tepkiler bitmiyor.<br \/>\nSon bir y\u0131l i\u00e7inde hayata ge\u00e7irilen yeni ekleme bina ve tesisler dava konusu olmu\u015ftu. Bir tepki de Mimar Abdullah Y\u0131lmaz &#8216;dan geldi.<br \/>\nSosyal medya hesab\u0131 \u00fczerinden, &#8220;Mimar sadece proje \u00e7izmez. Ya\u015fad\u0131\u011f\u0131 kente diyet borcu vard\u0131r. Kentine sahip \u00e7\u0131kar. Liyakat ve haysiyet sahibi olarak&#8230;&#8221; \u015feklinde Mersin Marina Yat Liman\u0131&#8217;n\u0131n yasa tan\u0131maz bir al\u0131\u015fveri\u015f merkezine d\u00f6n\u00fc\u015ft\u00fc\u011f\u00fcn\u00fc ve kamuoyu yarar\u0131 g\u00f6zetmedi\u011fini a\u00e7\u0131klad\u0131.<br \/>\nMersin&#8217;in \u00f6nde gelen isimlerinin de ticari \u00e7\u0131kar do\u011frultusunda dava \u00fczerine gitmedi\u011fini ele\u015ftiren a\u00e7\u0131klamada Y\u0131lmaz, &#8220;Mersin yat liman\u0131n\u0131n, maalesef dev bir al\u0131\u015fveri\u015f merkezinin s\u00fcs havuzu olmu\u015ftur. Ki\u015fisel rant u\u011fruna anayasa ve k\u0131y\u0131 yasas\u0131na ayk\u0131r\u0131 olarak sahil beton y\u0131\u011f\u0131n\u0131na d\u00f6n\u00fc\u015ft\u00fcr\u00fclm\u00fc\u015ft\u00fcr. Her zamanki gibi, her d\u00f6nemin dalkavuklar\u0131, sivil toplum \u00f6rg\u00fctlerinin pek \u00e7o\u011fu, kent duayenleri denilen kibar soyguncular, marinan\u0131n dev bir al\u0131\u015fveri\u015f merkezine d\u00f6n\u00fc\u015fmesine kar\u015f\u0131 \u00fc\u00e7 maymunlar\u0131 oynam\u0131\u015flar.Yeni yap\u0131lan d\u00fckkanlardan bir tane kapmak i\u00e7in \u00e7ok b\u00fcy\u00fck efor sarfetmi\u015flerdir. Haram, z\u0131kk\u0131m olsun.&#8221; diyerek tepki g\u00f6sterdi.\u00a0<\/p>\n<p>&#8220;Dolgu alanlar\u0131na sabit yap\u0131 yap\u0131lamaz..!\u201d<\/p>\n<p>Anayasa\u2019ya g\u00f6re k\u0131y\u0131lar\u0131n kamunun kullan\u0131m\u0131na a\u00e7\u0131k ve devletin tasarrufu alt\u0131nda oldu\u011funu, k\u0131y\u0131 kanunun da k\u0131y\u0131da hi\u00e7bir yap\u0131 yap\u0131lamaz ve k\u0131y\u0131 halka kapat\u0131lamaz tek istisnas\u0131n\u0131n ise k\u0131y\u0131dan ba\u015fka yere yap\u0131lamayacak olan binalar; liman, iskele, \u00e7ekek yerleri, marinalar gibi, kanunla nas\u0131l yap\u0131labilecekleri d\u00fczenlenen yap\u0131la\u015fmalar oldu\u011funu hat\u0131rlatan mimar Abdullah Y\u0131lmaz, Anayasan\u0131n Kamu yarar\u0131n\u0131 d\u00fczenleyen 43. maddesi olan; &#8216;K\u0131y\u0131lar, devletin tasarrufu alt\u0131ndad\u0131r. Deniz, g\u00f6l ve akarsu k\u0131y\u0131lar\u0131yla, deniz ve g\u00f6llerin k\u0131y\u0131lar\u0131n\u0131 \u00e7evreleyen sahil \u015fehirlerinden yararlanmada \u00f6ncelikle kamu yarar\u0131 g\u00f6zetilir. K\u0131y\u0131larla sahil \u015feritlerinin, kullan\u0131\u015f ama\u00e7lar\u0131na g\u00f6re derinli\u011fi ve ki\u015filerin bu yerlerden yararlanma imkan ve \u015fartlar\u0131 kanunla d\u00fczenlenir.&#8217; dendi\u011finin alt\u0131n\u0131 \u00e7izdi.<br \/>\nY\u0131lmaz: &#8220;Dolay\u0131s\u0131yla, Mersin yat liman\u0131ndaki ticari ama\u00e7l\u0131 bina yap\u0131lamas\u0131, anayasa ve k\u0131y\u0131 kanununun ilgili h\u00fck\u00fcmlerine ayk\u0131r\u0131d\u0131r. Marina&#8217;n\u0131n in\u015faat alan\u0131, denizden doldurarak elde edilmi\u015f dolgu alanlard\u0131r. Kanuna g\u00f6re dolgu alanlar\u0131nda sabit yap\u0131 yap\u0131lamaz!&#8221; a\u00e7\u0131klamas\u0131nda bulundu.\u00a0<\/p>\n<p>&#8220;Yat\u0131r\u0131mc\u0131 halk\u0131n paras\u0131 ile destekleniyor&#8221;<\/p>\n<p>Mersin&#8217;in, bu k\u0131y\u0131 kesiminde do\u011fal g\u00f6r\u00fcn\u00fcm\u00fcn yok oldu\u011funu ve do\u011fal g\u00f6r\u00fcn\u00fcm\u00fcn yerini, sahil \u015feridi boyunca, yat liman\u0131n\u0131n varl\u0131\u011f\u0131n\u0131n dahi hissedilmedi\u011fi kentsel tarihi ve do\u011fal dokuya uygun olmayan \u00e7elik, cam, vb. yap\u0131 malzemelerinden m\u00fcte\u015fekkil, estetikten yoksun g\u00f6r\u00fcn\u00fcml\u00fc dev al\u0131\u015fveri\u015f merkezinin in\u015fa edildi\u011fini belirten Y\u0131lmaz, \u201cKent ve k\u0131y\u0131 ili\u015fkisi yok olmu\u015ftur. \u0130nsan ile deniz aras\u0131, ba\u015ftanba\u015fa ticari nitelikli binalar kaplanm\u0131\u015ft\u0131r. Maliyetinin kamuya y\u00fcklenece\u011fi dolay\u0131s\u0131yla, yat\u0131r\u0131mc\u0131 asl\u0131nda halk\u0131n paras\u0131 ile desteklenmi\u015ftir.&#8221; ifadelerini kulland\u0131.\u00a0<\/p>\n<p>&#8220;Bilinmesi gereken ger\u00e7ekler&#8221;\u00a0<\/p>\n<p>Mersin Marina Yat Liman\u0131\u2019n\u0131n, 1993 y\u0131l\u0131nda 110 milyar dolar ile ihale edildi\u011fini, temelinin 1994 y\u0131l\u0131nda at\u0131l\u0131p, 500 yat ba\u011flama ve 320 yat karaya alma kapasitesiyle Do\u011fu Akdeniz&#8217;in en b\u00fcy\u00fck yat liman\u0131 oldu\u011funu a\u00e7\u0131klamas\u0131na ekleyen mimar Y\u0131lmaz, \u201c2009 Y\u0131l\u0131 Yat\u0131r\u0131m Program\u0131&#8217;nda yer alm\u0131\u015f, Mersin Yat Liman\u0131 ile ilgili olarak \u00fcst yap\u0131 in\u015faat\u0131, &#8216;yap-i\u015flet-devret modeli&#8217; ile ihaleye \u00e7\u0131kart\u0131lm\u0131\u015f, A\u011fustos 2009&#8217;da b\u00f6lge m\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan y\u00fcklenici firmaya devredilmi\u015ftir.&#8221; dedi.\u00a0<br \/>\nLiman\u0131n, 25 y\u0131ll\u0131\u011f\u0131na s\u00f6z konusu firmaya kiraland\u0131\u011f\u0131n\u0131 ve projeyle birlikte limanda 6 milyon 137 bin 307 dolarl\u0131k bir yat\u0131r\u0131m\u0131n ger\u00e7ekle\u015fmesinin \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fcn\u00fc belirterek, Mersin yat liman\u0131n y\u0131ll\u0131k kullan\u0131m bedelinin, 102 bin 380 TL oldu\u011funu da s\u00f6zlerine ekledi.\u00a0<br \/>\nMersin Yat Liman\u0131 Marina projesinin, ihale a\u015famas\u0131ndaki \u00f6zelliklerine a\u00e7\u0131klamas\u0131nda yer veren Y\u0131lmaz, Marinaya ili\u015fkin \u015fu bilgileri verdi;<br \/>\n\u201cAna dalgak\u0131ran boyu: 1140 metre, Tali dalgak\u0131ran boyu: 265 metre, Toplam iskele ve r\u0131ht\u0131m yana\u015fma yeri uzunlu\u011fu: 2 bin 500 metre, Korunmu\u015f su alan\u0131: 160 bin metrekare, Fener kulesi: 2 adet, Marina geri saha alan\u0131: 145 bin metrekare, Marina kapasitesi: 500 yat&#8221;bilgisini payla\u015farak projenin, bu temalar \u00fczerine tasarland\u0131\u011f\u0131n\u0131 belirtti.\u00a0<\/p>\n<p>&#8220;Projeye ayk\u0131r\u0131 kullan\u0131m&#8221;\u00a0<\/p>\n<p>Mersin Yat Liman\u0131\u2019n\u0131n 2011 y\u0131l\u0131nda i\u015fletmeye a\u00e7\u0131ld\u0131\u011f\u0131n\u0131 ve yat liman\u0131 ile ilgili in\u015faat ruhsatlar\u0131n\u0131n, 2010 y\u0131l\u0131nda Yeni\u015fehir Belediyesi\u2019nce d\u00fczenlenmi\u015f olup Yeni\u015fehir Belediyesi\u2019nin, k\u0131y\u0131 mevzuat\u0131 kapsam\u0131nda ruhsat d\u00fczenlemeyle ilgili yetkinin, \u00e7evre ve \u015fehircilik il m\u00fcd\u00fcrl\u00fc\u011f\u00fcnde olmas\u0131 gerekti\u011fi d\u00fc\u015f\u00fcncesiyle verilen ruhsatlar\u0131 2011 y\u0131l\u0131nda iptal etti\u011finin vurgusunu yapan Y\u0131lmaz, &#8220;Bu tarihten, 2016 y\u0131l\u0131na kadar iptal edilen ruhsatlar\u0131n hangi kurum taraf\u0131ndan verildi\u011fi bilinmemektedir. Bilinen Mersin \u00c7evre ve \u015eehircilik \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc&#8217;nce, yat liman\u0131n\u0131n ticari alanlar\u0131n\u0131n artmas\u0131 ana temal\u0131, B-C-D-F-G-H-I ve J bloklar\u0131 i\u00e7in 05\/05\/2016 tarih ve 2016\/1-2 say\u0131l\u0131 tadilat yap\u0131 ruhsatlar\u0131n\u0131n d\u00fczenlendi\u011fi, ayn\u0131 bloklar i\u00e7in 06\/05\/2016 tarih ve 2016\/1-2 say\u0131l\u0131 yap\u0131 kullanma izin belgesi d\u00fczenlendi\u011fidir. Yat liman\u0131n\u0131n amac\u0131n\u0131n d\u0131\u015f\u0131nda al\u0131\u015f veri\u015f merkezine tam d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi i\u00e7in ilave in\u015faatlar\u0131n yap\u0131m s\u00fcrecinde; Mersin&#8217;de duyarl\u0131 bir vatanda\u015f\u0131m\u0131z taraf\u0131ndan Dan\u0131\u015ftay 1. Dairesi\u2019ne, in\u015fa edilen yat liman\u0131 in\u015faas\u0131n\u0131n eksik ve ayk\u0131r\u0131l\u0131klar\u0131na, \u00fcstyap\u0131 \u00e7al\u0131\u015fmalar\u0131n\u0131n 3194 say\u0131l\u0131 \u0130mar Kanunu ve 3621\/3830 say\u0131l\u0131 K\u0131y\u0131 Kanunu ve bu kanun \u00f6ncesi i\u00e7in ge\u00e7erli y\u00f6netmelikler esas al\u0131narak, marina avm yap\u0131la\u015fmas\u0131na, bakanl\u0131k nezdinde \u015fikayette bulunmu\u015f ve baz\u0131 g\u00f6revliler hakk\u0131nda su\u00e7 duyurusunda, bulunulmu\u015ftur.&#8221; dedi.\u00a0<br \/>\nDan\u0131\u015ftay 1. Dairesinin,\u015fikayete ili\u015fkin a\u00e7\u0131klad\u0131\u011f\u0131 kararda, Mersin Yat Liman\u0131 in\u015faat\u0131n\u0131n projesine uygun olup olmad\u0131\u011f\u0131 konusunda bilirki\u015fi incelemesi yap\u0131ld\u0131\u011f\u0131n\u0131 ve bilir ki\u015filerce d\u00fczenlenen raporda, \u00fcst yap\u0131 projesinde, \u00f6ncelikle Mersin B\u00fcy\u00fck\u015fehir Belediyesi imar y\u00f6netmeli\u011finin h\u00fck\u00fcmlerine ayk\u0131r\u0131 olarak, ticari alan tan\u0131m\u0131na giren yerlerin ticari olmayan alanlar olarak g\u00f6sterildi\u011fini belirten Y\u0131lmaz, &#8220;Asma katlar\u0131n tan\u0131mlamaya uymad\u0131\u011f\u0131, s\u00f6z konusu projede 2.037, 86 m2 ticari alan belirtilmesine ra\u011fmen alan\u0131n tamam\u0131n\u0131n y\u00fczde 1 olan ticari alan hesab\u0131n\u0131n a\u015f\u0131ld\u0131\u011f\u0131, projeye ayk\u0131r\u0131 olarak kazan\u0131lan asma kat ve birinci katlar\u0131n projeye ayk\u0131r\u0131 olarak kazan\u0131ld\u0131\u011f\u0131, ayr\u0131ca tavan projeden sonra 2011 tarihinde revize edilen projenin Mersin B\u00fcy\u00fck\u015fehir Belediyesi imar y\u00f6netmeli\u011fine ve planl\u0131 alanlar maddelerine de ayk\u0131r\u0131 oldu\u011fu, ayn\u0131 zamanda onayl\u0131 projeye ayk\u0131r\u0131 kullan\u0131m ve imalat\u0131n bulundu\u011fu, ticari alan hesab\u0131n\u0131n yanl\u0131\u015f oldu\u011fu g\u00f6r\u00fc\u015flerine yer verilmi\u015ftir.&#8221; diye a\u00e7\u0131klad\u0131.\u00a0<\/p>\n<p>&#8220;Bakanl\u0131k soru\u015fturmaya izin vermemi\u015fti..!\u201d<\/p>\n<p>Dan\u0131\u015ftay\u2019\u0131n bilirki\u015filerinin tuttu\u011fu rapor sonras\u0131nda, \u00e7evre ve \u015fehircilik bakanl\u0131\u011f\u0131ndaki teknik g\u00f6revlilere de Mersin yat liman\u0131 hakk\u0131nda inceleme raporu d\u00fczenlemesinin istenildi\u011fini ve raporda da, yat liman\u0131ndaki yap\u0131lar\u0131n her ne kadar k\u0131y\u0131 kanununda yer almasa da deniz turizm y\u00f6netmeli\u011fi a\u00e7\u0131s\u0131ndan uygun oldu\u011funu belirten Y\u0131lmaz, \u201cFakat ticari alan olarak kullan\u0131lan alan\u0131n projeye g\u00f6re fazla oldu\u011fu g\u00f6r\u00fc\u015flerine yer verilmi\u015ftir. \u0130ki farkl\u0131 bilirki\u015fi raporunu inceleyen ula\u015ft\u0131rma bakanl\u0131\u011f\u0131, iki rapor aras\u0131ndaki \u00e7eli\u015fkileri gerek\u00e7e g\u00f6stererek, \u2018g\u00f6revi k\u00f6t\u00fcye kullanmakla\u2019 su\u00e7lanan 2 b\u00fcrokrat ve 16 personel hakkinda soru\u015fturmaya izin vermemi\u015ftir! Bunun \u00fczerine \u015fik\u00e2yet\u00e7i vatanda\u015f, Ula\u015ft\u0131rma Bakanl\u0131\u011f\u0131&#8217;n\u0131n bu karar\u0131na kar\u015f\u0131 dan\u0131\u015ftay nezdinde tekrar dava a\u00e7m\u0131\u015ft\u0131r.&#8221; dedi.\u00a0<br \/>\nDavay\u0131 g\u00f6r\u00fc\u015fen Dan\u0131\u015ftay \u00a01.
